These Terms of Service ("Terms") govern your use of QualyCheck ("Service"), operated by QualyCheck ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
QualyCheck is a field service inspection and quality tracking platform. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You are responsible for maintaining the confidentiality of your account credentials including your username and PIN. You are responsible for all activity that occurs under your account. Notify us immediately at hello@qualycheck.app if you suspect unauthorized access to your account.
QualyCheck is offered on a subscription basis. By providing payment information, you authorize us to charge your payment method for the applicable subscription fee. Subscriptions automatically renew unless canceled before the renewal date. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.
New accounts receive a 14-day free trial. Your payment method will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you input into the Service. By using the Service, you grant us a limited license to process your data for the purpose of providing the Service.
We take reasonable measures to protect your data. However, no method of transmission or storage is 100% secure. You acknowledge that you provide data at your own risk. We are not liable for any unauthorized access to your data resulting from circumstances beyond our reasonable control.
You are responsible for ensuring that your use of the Service complies with applicable employment laws regarding employee monitoring and data collection. By using QualyCheck to track employee performance, you represent that you have appropriate authority and, where required, consent to collect and store this information.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any losses resulting from service interruptions.
To the maximum extent permitted by law, QualyCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time by contacting us at hello@qualycheck.app.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a notice within the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Michigan.
